I heard that China has already granted software patents.
A Debian Developer confirmed it in his blog.

目前中国从专利法上来说是不承认软件专利的，以软件申请专利也是无法通过的。
因此，一些厂商或研究机构为了能够获得专利，在专利申请书中特别将软件“打扮”的像硬件专利的样子，
一般来说专利局的负责审查的官员并不懂计算机技术，软件专利就这样得以通过。
至于以后出现了专利争执的话，天知道事情会变成什么样。
